Increase in rents in 2022: calculation & information
Rent increases are strictly regulated by law. When does your landlord have the right to increase it? How much can your rent increase in 2022? We give you all the information you need to know on the subject!
Does the landlord have the right to increase the rent?
Your landlord can choose to increase your rent if:
- Once a year, if your rental contract provides for it: the revision date is specified in the lease. If this is not the case, it is the date of signature of the lease which will have to be taken into account.
- When renewing the lease, if the rent was undervalued: to prove it, your landlord must provide you with at least 3 specific references (6 for towns of more than one million inhabitants) to justify the new rent. To be able to apply the increase, your landlord will need to obtain your agreement. If he does not get it, the judge will decide.
- Exceptionally, if improvement work is carried out in the accommodation: the work must bring added value to the accommodation (installation of a digicode, or a fitted kitchen, for example). The landlord must agree with you on the amount of the rent increase, which can only take place once the work has been completed.
What is the legal rent increase for 2022?
The rent increase for 2022 is based on the Rent Reference Index (IRL).
For the 1st quarter of 2022, INSEE has set the IRL at 133.93, i.e. an annual increase of 2.48%.
Yes, but then, concretely, what does that mean for your rent? Well, if your rental lease provides for a rent review clause, and your landlord takes the step of activating it, he will have to take this figure into account when calculating the increase. How is the rent increase calculated?
Here is the calculation to know the amount of your new rent:
New rent = current amount of rent x new IRL of the reference quarter of the lease / IRL of the same quarter the previous year.
An example is worth a thousand words.
You signed your lease on February 1, 2021, for a rent of €800. This can be reassessed on February 1, 2022:
- The IRL at the time of signing the lease was that of the 1st quarter of 2021, namely 130.69.
- The IRL on the date of the rent reassessment is that of the 1st quarter of 2022, namely 133.93.
On February 1, 2022, the calculation of your new rent is: 800 x 133.93 / 130.69 = €819.83.
